Privacy policy
This page explains what personal information this site collects, why, how it is held, and what you can ask us to do with it.
Who we are
PropertyFacts.com.au is published by Oryx Capital Pty Ltd (ABN 79 167 673 878), which also trades as Gentry Finance. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the thirteen Australian Privacy Principles in it.
You can reach us about anything on this page at admin@gentryfinance.com.au. If you would like this policy in another format, ask and we will provide it, free.
Reading the site
You can read every page on this site without telling us who you are. We count page visits in aggregate so we know which pieces and tools are worth the work, and nothing in that counting identifies you. How it works is set out under Cookies and measurement below.
What we collect, and why
The only personal information this site collects is what you type into an enquiry form. Those forms sit behind clearly labelled advertisements and ask for your first name and email address, and optionally a phone number, a suburb or postcode, and a message. Name and email are required so a person can reply; everything else is optional.
We collect it to reply to your enquiry and, if you ask us to, to introduce you to a provider. If you don't provide it, we cannot reply.
Each enquiry page says, above the form, exactly what will happen with what you send: which enquiries are followed up by Gentry Finance, and which are answered personally by the editor with an introduction offered rather than made automatically. We do not pass your details to a third party without telling you who first.
If you send us something we did not ask for and could not have collected ourselves, we take reasonable steps to destroy or de-identify it as soon as practicable, unless the law requires us to keep it.
Who we disclose it to
- Gentry Finance, which is the same company as the publisher, for finance enquiries. If Gentry goes on to help you with a loan, its own privacy policy and credit guide cover that work; this page covers the website.
- HubSpot, the customer records system Oryx Capital uses, where enquiries are stored. HubSpot holds our records in its Australian data centre.
- A provider we introduce you to, only after you have said yes to the introduction and been told who it is.
We do not sell your information, and we do not disclose it for anyone else's marketing.
Information handled overseas
Enquiry records are held in Australia. Where Oryx Capital uses artificial-intelligence tools in its work, it de-identifies information first; that is described in the Gentry Finance privacy policy, which governs any work Gentry does for you beyond this website.
Marketing, and how to stop it
Sending an enquiry does not sign you up to a mailing list. If we later start a newsletter, it will be a separate opt-in, and every message will carry an unsubscribe link. You can also just tell us, and we will stop.
Cookies and measurement
This site carries no advertising pixels and no third-party tracking scripts. Advertisements on the site are served from our own server, and clicking one is counted on our own server; no advertiser or ad network receives anything about you from us. We do not build a profile of your visit, and we give no one else information about what you read here.
We measure the site in one limited way: a small first-party tool counts page visits and how far down a page people read. It sets no cookie, records no name, email or phone number, and the figures never leave this site's own database. We can see that a page was read; we cannot see that you read it.
The enquiry form sets no cookie.
How we hold it, and for how long
Enquiries are written to a log stored outside the public area of our web server, readable only by us, and deleted after 90 days. That log exists so an outage at HubSpot cannot lose your enquiry.
Your enquiry record in HubSpot is kept for two years from our last contact with you, and then deleted, unless you become a client of Gentry Finance, in which case Gentry's policy governs. You can ask us to delete it sooner.
When we no longer need information and no law requires us to keep it, we take reasonable steps to destroy or de-identify it.
We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access. No system is perfect. If a data breach happens and it is likely to cause you serious harm, the Notifiable Data Breaches scheme in the Privacy Act requires us to tell you and the Office of the Australian Information Commissioner as soon as practicable, and we will.
Getting access, or correcting it
You can ask us for a copy of the personal information we hold about you, and ask us to correct it if it is wrong, out of date or incomplete. There is no charge for asking, and no charge for making a correction. We will acknowledge your request within 7 days and answer it within 30 days.
If we refuse access or refuse to correct something, we will tell you why in writing and how to challenge it. If we will not make a correction you have asked for, you can ask us to attach your own statement to the record, and we will.
How to contact us, and how to complain
Email admin@gentryfinance.com.au first and we will work through it with you. We will acknowledge a complaint within one business day and give you a decision within 30 days.
If you are not satisfied with our response, or we have not answered you in 30 days, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992. You do not have to come to us first, though it is usually quicker if you do. Oryx Capital is also a member of the Australian Financial Complaints Authority (membership 119192), which can consider privacy complaints connected to credit.
Changes
We update this policy when what we do changes. The date at the top is the date of the current version. If a change materially affects how we handle information we already hold about you, we will tell you rather than rely on you noticing the date.
